Terms of Service

These terms are an agreement between you (the business using AvaGotYa) and Full Stack Woo, LLC (doing business as Avakata) ("Avakata", "we"). Plain English on purpose. By creating an account or installing the tag, you agree to them.
1. What AvaGotYa does
AvaGotYa scores visits to your website for signs of invalid traffic (bots, click farms, automated and repeat clicking) and, when you turn protection on, adds the worst sources to your ad accounts' exclusion lists so future ads aren't shown to them. Detection happens after a click reaches your site; we do not and cannot stop a click before it happens.
2. Shadow mode first
Every site starts in shadow mode: we observe and report, nothing is excluded and nothing is billed. Shadow mode lasts at least 14 days and continues until you choose to turn protection on. You can return to shadow mode, or switch everything off, at any time.
3. Price
The software is free. When protection is on, the monthly fee is:
- 30% of the month's Conservative verified savings — the value of paid clicks from sources we had excluded, priced at your own cost-per-click,
- after subtracting any invalid-click credits Google gave you for the same month (from the API, plus any you enter on your statement),
- capped at 3% of that month's ad spend,
- and $0 if there are no verified savings.
We never charge based on traffic volume, and shadow-mode months are never billed. The one condition of the free software is that read-only visibility of your ad spend stays connected, because without it we cannot verify savings or subtract Google's credits — so without it the fee is $0.
4. Statements, invoices and disputes
Each month closes on the 2nd. Your statement shows every billed click. You can dispute any line; disputed lines come off the invoice while we review, and you never pay a disputed line first. If a source we excluded turns out to have been a real customer (for example, it later converted), that click is removed from the fee. Invoices are issued through PayPal and are due within 15 days.
5. What we don't promise
No fraud-detection system is perfect. We do not promise any particular amount of savings, and we do not promise refunds or credits from Google or any other ad platform — those decisions belong to the platform. Evidence exports we produce are yours to submit; Google states that it doesn't analyze or validate third-party data as part of invalid-traffic investigations. AvaGotYa is not an insurance product.
6. Your responsibilities
- Install the tag only on sites you control, and keep a privacy notice on them that covers fraud prevention and analytics.
- Obtain any consent your jurisdiction requires before the optional session-replay feature records anything (it is off by default).
- Review exclusions in soft mode, and keep your allow-list current (office IPs, partners, known customers).
- Don't use AvaGotYa to target, identify or harass individuals, or to harm competitors.
7. Your data
You own your data. We process it only to provide the service, as described in the Privacy Policy and the Data Processing Addendum, which form part of these terms. We don't sell it. We never name or accuse any individual or company as the source of fraudulent clicks.
8. Access to your Google accounts
Connecting Google Ads or Tag Manager uses Google sign-in. We request only the access shown on Google's consent screen, store Google Ads access encrypted, never store Tag Manager access beyond one hour, and use Google user data only to provide the features you turned on. Disconnecting in Integrations destroys our stored access immediately.
9. Availability
The tag is designed to fail open: if our service is unavailable, your site and ads keep working and nothing is excluded. We may change or improve the service; we'll give 30 days' notice of any change to the price formula, and changes never apply to a month already in progress. Founding 50 members keep their rate for 24 months from signup.
10. Ending
You can cancel any time by removing the tag and disconnecting your accounts; the current month's statement still closes normally. We may suspend accounts that break these terms. Sections 3–5, 7 and 11–12 survive.
11. Liability
The service is provided as is. To the extent the law allows, neither party is liable for indirect or consequential losses, and our total liability in any 12 months is limited to the fees you paid us in those 12 months.
12. Law
Florida law governs these terms, and disputes go to the state or federal courts in Palm Beach County, Florida. Questions: ryan@avakata.agency.
